General Terms and Conditions
1. General
1.1 The sales contract is made between you, the customer and optiking, Eberswalder Str. 34, 10437 Berlin, Germany, Phone +49(0)30 47 37 24 88. 1.2 By submission of a bid you agree to the general terms and conditions and declare your legally binding intention for the purchase of your order.
2. Payment

3. Retention of Title
The commodity remains the property of optiKing until the completion of the full payment by the customer with fully reserved proprietary rights.
4. Prices
4.1 The prices are always listed in Euros (EUR) or US-Dollars (US$), where applicable, within the article description, and include the legally valid value added tax. The prices apply at the time of the order. 4.2 Shipping and handling costs are paid by the customer, as specified in point 5 "Shipping and Handling". 4.3 In individual cases of transnational deliveries further charges (such as customs duty), to be paid by the customer, may apply.
5. Shipping and Handling
5.1 The dispatch of the commodity takes place exclusively upon advance payment. 5.2 The dispatch of the commodity takes place, if no other agreement is made, within 1-3 business days after receipt of payment. 5.3 The commodity is dispatched exclusively through Deutsche Post (airmail). 5.4 Immediately upon dispatch the customer receives a shipping transaction number which can be used to inquire about the delivery status of the shipment by calling the number 01801/805555 (4.6 cent per minute within the German landline). Additionally the delivery status can be viewed at www.deutschepost.de/briefstatus. 5.5 Each shipment is insured up to a amount of 25 Euros, if no additional agreement is made. 5.6 Alternate dispatch desires (e.g. a higher insurance sum) must be sent in writing by the customer to optiking.
6. Right of Rescission and Warranty
6.1 The customer has the right to recall the contract without indication of reasons within 14 days. The period begins at the earliest with receipt of the commodity and this instruction. 6.2 The revocation can take place in writing or by sending the commodity back. The revocation is to be addressed in writing to optiking within the prescribed period. In order to return the commodity it should be sent to Carsten Dennhardt, Eberswalder Str. 34, 10437 Berlin, Germany. 6.3 In the case of an effective revocation the payment / commodity exchanged is to be refunded by both sides. 6.4 The obligation to send back the commodity is incumbent upon the customer. In the case of a return consignment in an unobjectionable state of the commodity optiKing will refund the complete purchase price. If the customer uses his right of rescission he is responsible for arising costs regarding the return shipment of the commodity if the purchase order value was below 40 EUR. If the purchase order value exceeds 40 EUR, optiKing will cover the costs of shipping, insofar it takes place with the same mode of shipment and the same dispatch service as dispatched by optiKing. The commodity is to be packed in a manner safe for transportation. 6.5 The two-year material defect warranty prescribed by the European Union cannot be warranted by optiKing, since the offered commodity consists exclusively of items which are at least as old as 10 years or more. Therefore they do not consist of new goods. The warranty is limited to 12 months.
7. Place of Jurisdiction and Applicable Law
The place of jurisdiction for possible disputes arising from the contract is Berlin, Germany.
8. General Terms
8.1 Verbal sub-agreements do not exist. Changes and additions to the contract and/or the general terms and conditions require to be done in writing. 8.2 If a clause or term as specified in the contract and/or the general terms and conditions is partially or entirely without effect, the effectiveness of all other clauses and terms remain unchanged.
